Most Depositions Are Polite and Professional

Despite how they may be depicted on TV, most depositions in civil cases are very straightforward. The attorneys involved will be polite and professional. The other party’s attorney may even be friendly toward you – remember that they want you to give as much information as possible.

Most depositions follow a format. Your personal injury attorney is not able to give you answers during the deposition, but we can work with you before the deposition. We will discuss the likely questions and prepare you for them. They are likely to ask about the following:

  • Personal information. This will be very general and include things like your name, background, contact information, and occupation.
  • Your prior physical state. They will generally ask about your health before the accident and injury you are suing for. For example, if you suffered a burn injury on your arm, they will ask if you have had prior injuries or burns to your arm.
  • The accident. They are going to want to determine the specifics of the accident. You will be asked questions like the time the accident occurred, who was there, what the weather conditions were, what your mental state was, who you talked to, and other facts. This is an important part to practice with your attorney as it is easy to get caught up and lose your train of thought or say something that may seem to go against your claim.
  • The injury. They will likely ask how the injury occurred, when you were treated, what ongoing care you have had, what follow-up care you had, and if you have followed your doctor’s advice, amongst other questions.
  • Your physical state now. Finally, they are going to ask about your life after the accident. You will have the chanced to explain how the injury you suffered has affected your life. You will talk about any limitations you have, ways your life has changed and affects on your family.
